- The injured worker does not have to prove that the employer—or anyone—was negligent in order to secure compensation; and
- The injured worker is only eligible for certain benefits, such as lost wages and medical coverage
This compromise was designed to ensure that injured workers received necessary benefits, such as access to medical care, without the need for stressful and time-consuming legal battles. In return, employer liability was limited: workers’ compensation does not provide for damages such as pain and suffering, and does not allow for punitive damages.
